Senator Pan is at it again. The same pharma-loving, pediatrician-turned-Senator who passed SB 277, a 2015 law that stripped away religious and personal belief exemptions from all vaccines on the current schedule, has further tightened his grip on parental medical choice with the introduction of SB 871.
SB 871 adds Covid-19 to the required list of vaccines for all students attending in-person school K – 12 (and various childcare centers.)
SB 871 also removes the personal belief exemption allowance entirely from the Covid-19 vaccine and all future vaccines added to the schedule. Current CA Law & SB 277It is important to understand how SB 871 builds upon SB 277, which removed the personal belief exemption¹ and the religious exemption² for all existing vaccines³ required for children to attend public and private schools and child care centers.
The only exemption which remained under SB 277 was the personal belief exemption, which applies for all additional immunizations added to the schedule by the California Department of Public Health (CDPH.) The personal belief exemption is now in danger of being eliminated entirely under SB 871.
Endless Boosters? Unlimited Vaccines? SB 871 will grant the CDPH power to require an unlimited amount of new vaccines and/or boosters for schoolchildren, with no exemptions remaining for parents to opt-out.With discussions of boosters for the Covid-19 vaccine possibly being required every year or even as often as every 3 or 4 months, allowing the CDPH to require new vaccines or perhaps boosters without a personal belief exemption opens the door for unlimited types and numbers of vaccines without going through the legislative process in which parents have at least some limited ability to voice their concerns. This is the equivalent of the state legislature passing a law but in much less time than it takes to pass a law.

Footnotes:
¹A personal belief exemption. A provision in the state law, which allows parents to exempt their children from the school vaccine requirement if it contradicts parental beliefs beyond those considered religious or spiritual beliefs.”
²A religious exemption. A provision in the state law, which allows parents to exempt their children from the school vaccine requirement if it contradicts their religious beliefs.” Ironically, school-aged children have less rights and protections than employees with regard to religious exemptions. Children’s rights to religious exemptions are controlled by the state legislature.
³ Current Immunization Schedule for Schoolchildren in California. According to the California Department of Public Health (CDPH) Immunization Branch, existing vaccines under current California law, Cal Health & Safety Code § 120325 include Diphtheria, Hepatitis B, Haemophilus influenzae type b, Measles, Mumps, Pertussis (whooping cough), Poliomyelitis, Rubella, Tetanus, Varicella (chickenpox).
